Terms of Service

Agreement to Terms

By accessing or using WhyTho ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the App.

These Terms apply to all users of the App, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Use License

Permission is granted to temporarily download one copy of WhyTho for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained in the App
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by WhyTho at any time.

Account Registration

Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must be at least 13 years old to create an account

Account Security

• You must immediately notify us of any unauthorized use of your account
• We are not liable for any loss or damage arising from your failure to protect your account
• You may not share your account with others

User Content

Content Responsibility

• You are solely responsible for all content you submit, post, or display through the App
• You retain ownership of your content but grant us a license to use it
• You represent that you have the right to submit all content you provide

Prohibited Content

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, or defamatory
• Violates any third-party rights, including intellectual property rights
• Contains viruses or malicious code
• Is spam or unsolicited commercial content
• Impersonates any person or entity

Content License

By submitting content, you grant WhyTho a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and improving the App.

Premium Subscriptions

Subscription Terms

• Premium features are available through paid subscriptions
• Subscriptions are billed on a recurring basis (monthly or annually)
• Subscription fees are charged in advance
• Prices may change with 30 days' notice

Payment

• Payments are processed through third-party payment processors (Apple, Google, Stripe)
• You agree to provide current, complete, and accurate purchase information
• All fees are non-refundable except as required by law
• You are responsible for any taxes applicable to your subscription

Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Refunds may be available in accordance with applicable law and platform policies

Intellectual Property

The App and its original content, features, and functionality are owned by WhyTho and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not use our trademarks, logos, or other proprietary information without our prior written consent.

Prohibited Uses

You agree not to use the App:

• In any way that violates any applicable law or regulation
• To transmit any malicious code or viruses
• To attempt to gain unauthorized access to any part of the App
• To interfere with or disrupt the App or servers
• To collect or harvest information about other users
• For any fraudulent or illegal purpose
• To impersonate any person or entity

Disclaimer

The information on the App is provided on an "as is" basis. To the fullest extent permitted by law, WhyTho:

• Excludes all representations, warranties, and conditions relating to the App
• Excludes all liability for damages arising out of or in connection with your use of the App
• Does not guarantee the accuracy, completeness, or usefulness of any information
• Does not warrant that the App will be uninterrupted, secure, or error-free

Financial Advice Disclaimer: WhyTho provides financial tracking and insights tools. The App does not provide financial, investment, or tax advice. You should consult with qualified professionals for financial advice.

Limitation of Liability

In no event shall WhyTho, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, trojan horses, or the like that may be transmitted through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

Indemnification

You agree to defend, indemnify, and hold harmless WhyTho and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the App
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your content caused damage to a third party

Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or delete your account through the App settings.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
